2.1 Admission Requirements

Entry to APEX Las Vegas requires:

• Valid admission ticket or reservation confirmation
• Compliance with age restrictions for certain areas (veterinary hospital, research facilities)
• Acceptance of security screening and bag inspection
• Agreement to surveillance and monitoring for safety and security
• Adherence to dress code and safety requirements

2.2 Prohibited Conduct

The following actions are strictly prohibited:

• Harassment, intimidation, or threatening behavior toward guests, staff, or animals
• Unauthorized feeding, touching, or interaction with animals
• Tampering with exhibits, bio-sovereign infrastructure, or safety systems
• Possession of weapons, drugs, or illegal substances
• Recording or photographing in restricted areas without permission
• Disruptive behavior or public intoxication
• Unauthorized commercial photography or videography
• Violating posted signage or staff instructions

Violation of these rules may result in immediate expulsion without refund and potential legal action.

3.1 Hospitality Reservations

For hotel accommodations (7,500 keys across The Canopy, Bio-Sphere, and other towers):

• All reservations require valid payment method and contact information
• Rates are dynamic and subject to change until booking is confirmed
• Check-in time: 4:00 PM | Check-out time: 11:00 AM (unless modified)
• Cancellation policies vary by rate type (see booking confirmation)
• No-show reservations forfeit first night payment
• Minimum age for primary guest: 18 years

3.2 Event and Tour Bookings

For educational programs, tours, and events:

• Advanced booking recommended (capacity limits apply)
• Cancellations must be made 48 hours before scheduled time for full refund
• APEX Las Vegas reserves the right to cancel or reschedule events
• Special dietary and accessibility needs must be communicated at booking

3.3 Payment Terms

Payment processing:

• All payments processed through PCI DSS Level 1 compliant systems
• Accepted methods: major credit cards, debit cards, digital wallets
• Full payment required at time of booking unless otherwise specified
• Resort fees, taxes, and applicable charges disclosed before confirmation
• Refunds processed within 7-10 business days to original payment method

4.1 APEX Las Vegas Property

All content, trademarks, and intellectual property on our platforms are owned by Mountain the Apex Las Vegas or licensed from third parties:

• APEX Las Vegas name, logo, and branding
• Website design, architecture, and functionality
• Educational content, research publications, and scientific data
• Photographs, videos, and multimedia content
• Bio-Dome designs and bio-sovereign technology specifications

Unauthorized use, reproduction, or distribution is prohibited and may violate copyright, trademark, and other laws.

4.2 User-Generated Content

By posting content on our platforms (reviews, photos, social media):

• You grant APEX Las Vegas a perpetual, worldwide, royalty-free license to use, reproduce, and distribute your content for marketing and promotional purposes
• You represent that you own or have rights to the content
• You agree not to post illegal, offensive, or copyrighted material
• APEX Las Vegas reserves the right to remove any content without notice

5.1 Assumption of Risk

APEX Las Vegas is an exotic animal facility with inherent risks:

• You acknowledge that exotic animals can be unpredictable
• Bio-Dome environments may include varying temperatures, humidity, and terrain
• Physical activities (tours, educational programs) carry risk of injury
• You assume all risks associated with your visit
• Parents/guardians are responsible for supervising minors at all times

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• APEX Las Vegas is not liable for indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the amount paid for services
• We are not responsible for theft, loss, or damage to personal property
• We are not liable for service interruptions due to force majeure (natural disasters, emergencies, government orders)
• Nevada law governs liability limitations

5.3 Indemnification

You agree to indemnify and hold harmless APEX Las Vegas, its officers, employees, partners, and affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your conduct at our facility

6.1 One Health Data Platform

APEX Las Vegas operates advanced research programs:

• Research data is licensed to pharmaceutical companies, universities, and research institutions
• All human subject research complies with IRB (Institutional Review Board) protocols
• Animal research adheres to IACUC (Institutional Animal Care and Use Committee) standards
• Participation in research programs requires separate informed consent

6.2 Veterinary Services

The Apex Anchor veterinary hospital:

• Provides care exclusively for exotic animals (not domestic pets)
• Veterinary records are confidential and HIPAA-compliant
• Emergency services available 24/7 for facility animals
• Visiting animal care requires pre-approval and transfer agreements

8.1 Tax-Deductible Donations

As a 501(c)(3) nonprofit organization:

• Donations are tax-deductible to the extent allowed by law
• Tax receipts issued for donations $250 or more

• Donations are non-refundable unless misprocessed
• Donor privacy protected per Donor Bill of Rights

8.2 Naming Rights and Major Gifts

Corporate partnerships and major donor programs:

• Subject to separate gift agreements and contracts
• Naming rights perpetual or time-limited as specified in agreement
• Recognition benefits detailed in donor prospectus
• Legacy 10 program for transformational gifts ($100M+)

10.1 Governing Law

These Terms are governed by the laws of the State of Nevada and the United States, without regard to conflict of law principles.

10.2 Arbitration Agreement

Disputes shall be resolved through binding arbitration:

• Arbitration conducted in Las Vegas, Nevada
• Governed by American Arbitration Association (AAA) rules
• Individual arbitration only (no class actions)
• You waive the right to jury trial
• Exceptions: Small claims court jurisdiction and injunctive relief

10.3 Venue

If arbitration does not apply, exclusive venue for legal proceedings is Clark County, Nevada.

11.1 Changes to Terms

We reserve the right to modify these Terms at any time. Changes effective immediately upon posting. Continued use constitutes acceptance.

11.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.
